Industrial Designs
The model and industrial design patent
has been abolished, however, they may be sensitive
to REGISTER OF INDUSTRIAL DESIGN for “all ornamental
plastic form of an object or the ornamental set of
lines and colors that can be applied to a product,
providing a new visual result and originality in its
configuration and which can be intended for industrial
manufacturing”.
A) Novelty
When it is not comprised in the state of art.
B) Priority
Provided for by the Paris Union Convention or International
Organization which produces a national filing effect.
C) Published
and Granted The application shall be immediately
after being published and granted.
D) Term
of duration Ten years as of the filing date
allowed to be extended for three seccessive periods
of five years each.
E) Examination
The holder of the registration shall apply for the
examination of merit, that is, as for the aspects
of the novelty and originality.
F) Administrative
Invalidation It may be made by the office or
at the request of the interest party within five years
as of the dated it is granted.
G) Compensation
The compensation shall be fortnightly as of the second
period of five days as of the filing date.
