New brazilian act on patents and marks

The ruling act on RIGHTS AND OBLIGATIONS
RELATED TO THE INDUSTRIAL PROPERTY has been approved
and shall be in force as of May 14th 1997, with the
exception contained in article 231 which provides
for IMMEDIATE enforcement. Under these conditions,
as the act is approved, it shall be possible to file
patent applications related to substances, matters,
or products obtained by means or chemical processes,
and the substances, matters, mixtures or food, chemical-pharmaceutical
and drug products of any kind, as well as the corresponding
processes of obtainment and modification by those
who have guaranteed protection by treaty or convention
in force in Brazil, the date of the first filing abroad
being assured, provided that its object has not been
placed in any market by means of direct initiative
of the holder or by third parties with his knowledge,
nor have serious and effective preparations for the
exploration of the object of the patent application
been made.
